A proposed settlement has been reached in the class action lawsuit, Rogers v. CSX Intermodal Terminals, Inc., No. 2019-CH-04168, currently pending in the Circuit Court of Cook County, Illinois before the Honorable Allen P. Walker. The Settlement would resolve a lawsuit brought on behalf of persons who allege that CSX Intermodal Terminals, Inc. (“CSX” or “Defendant”) required individuals visiting its Illinois facilities between March 29, 2014, and January 29, 2021 to provide their fingerprints in order to enter the facilities without first providing them with legally-required written disclosures and obtaining written consent.
The Court has granted preliminary approval of the Settlement and has conditionally certified the Settlement Class for purposes of settlement only. This website explains the nature of the class action lawsuit, the terms of the Settlement, and the legal rights and obligations of the Settlement Class Members. If you are a Class Member, your rights will be affected, and you may be eligible for a payment from the Settlement. You are a member of the Settlement Class if you used the Fingerscan System at a CSX Intermodal facility in Illinois any time between March 29, 2014, and January 29, 2021.
